  • Judicial review refers to the power of a court to refuse to enforce statutes or administrative rules that, in the opinion of the judge or judges, conflict with the letter or the spirit of the constitution. Judicial review can serve to legitimate and facilitate the enforcement of limits on government and on majorities in constitutional democracies, but the practice of judicial review is controversial because it typically allows unelected judges to override majority preferences.
