  • Supreme Court justice noted for his solitary dissent in Plessy v. Ferguson (1896), which upheld the doctrine of “separate but equal.” John Marshall Harlan was nominated to the Court by President Rutherford B. Hayes (1877–1881) on October 17, 1877, to replace David Davis, who had resigned. Harlan was confirmed by the Senate on November 29, 1877, by a voice vote.
