mere evidence rule

Definición

  • The mere evidence rule was a common law search-and-seizure rule and property law that mandated that ownership rights trumped governmental evidentiary interests. The rule had an important impact on search and seizure law until 1967, when the United States Supreme Court eliminated the rule in the case of Warden v. Hayden.
