  • Justice Byron White, joined by Chief Justice William Rehnquist, used the case of Illinois v. Condon, 507 U.S. 948 (1993), to dissent from the U.S. Supreme Court's rejection of certiorari in a case involving application of the knock and announce rule. In the case, the State of Illinois sought review by the Court of a decision by the Illinois Supreme Court that ruled that a search of Timothy Condon's home, a warrant notwithstanding, was in violation of the Fourth Amendment.
