  • In a 5–4 ruling in Bowen v. United States, 422 U.S. 916 (1975), the Supreme Court held that a defendant's drug conviction should stand and not be overruled based on the use of a traffic checkpoint stop by law enforcement agents who acted without a warrant or probable cause. The Court ruled that the decision of Almeida-Sanchez v. United States (1973), which disapproved of such tactics near the border, would not be applied retroactively to provide the defendant any benefit.
