  • The automatic standing rule provides that individuals have standing to challenge an allegedly unlawful search or seizure even if they do not have a reasonable expectation of privacy in the place where the search or seizure takes place. Under the rationale of the automatic standing rule, even if individuals did not have such an expectation of privacy in the place, they would still have standing if they were legitimately on the premises or were in possession of an item that was seized by police.
