Concept information

Preferred term

military personnel and Fourth Amendment rights

Definition(s)

  • An article written in 1994 observed that the U.S. Supreme Court still had not explicitly stated that Fourth Amendment protections extend to members of the U.S. military, even though lower courts had routinely applied its provisions to such personnel (see Lederer and Borch 1994). Even if it is firmly established that Fourth Amendment protections apply, however, issues of reasonableness will often be interpreted differently in the military than in other contexts.
