- The ability of the criminal justice system to simultaneously deliver defendants' and victims' rights has been a concern throughout history. In the United States, defendants' rights are upheld by the Constitution; victims' rights have more recently been entered into the system through state statutes and constitutions as well as legislation of the federal government.
